Tom Prior is a senior associate in the Litigation team, predominately advising on commercial and corporate litigation.

Tom has strong advocacy experience, having appeared for clients and instructed senior counsel on a diverse range of matters in multiple state courts and administrative tribunals.

  • Experience in acting for clients in Corporations Act 2001 (Cth) applications and disputes.
  • Acting for a shareholder in oppressive conduct proceedings against the shareholder company in the Federal Court of Australia.
  • Advising a large privately owned resource development group on a dispute with its financial advisor regarding the payment of a success fee relating to the sale of mining tenements in Western Australia.
  • Acting for an NYSE-listed entity in proceedings in the Supreme Court of New South Wales regarding a commercial contractual dispute.
  • Acting for an ASX-listed company in tribunal proceedings regarding a contractual dispute concerning a multimillion-dollar property development.
  • Acting for a large property consortium in proceedings in the Supreme Court of New South Wales against its insurer relating to the insurer’s refusal to offer the company cover under an insurance policy.
  • Advising directors and companies in relation to insolvency and bankruptcy matters.
  • Appearing and instructing in the Western Australian Magistrates, District and Supreme Courts, the Federal Court of Australia, the State Administrative Tribunal and the New South Wales Supreme Court in respect of commercial disputes and administrative appeals.
  • Briefing senior counsel and expert witnesses in respect of matters before the Western Australian and New South Wales Supreme Courts and in commercial arbitrations.
