Mary Shaw is an associate in our Litigation Practice, based in the Perth office. Mary has experience assisting clients in relation to commercial disputes (including contractual and corporate shareholder disputes), property-related disputes and regulatory matters.

Mary has also completed graduate rotations in our Labour & Employment team, where she gained experience advising on employment-related disputes and general employment law matters, as well as our Real Estate Practice, where Mary assisted on commercial property leasing and development matters.

  • Assisting with representing a company director, as creditor, in relation to the recovery of monies provided by way of director’s loans to the company, which had since been placed in liquidation.
  • Acting for a company director and shareholder in relation to a dispute over the provisions of the shareholders agreement governing the circumstances under which the director would be entitled to acquire the holdings of the other shareholder. The dispute is occurring in the circumstances of a breakdown in the relationship between the shareholders.
  • Assisting with advice to consumer product manufacturers and suppliers regarding compliance with the Australian Consumer Law, as it relates to content on product labels and packaging (for example regarding sustainability credentials or product features).
  • Assisting the operator of a hotel in defending a claim of misleading and deceptive conduct in connection with precontractual representations.
  • Assisting a landowner in defending its title to newly acquired land from claims to adverse possession and easement of prescription from an adjoining landowner.
  • Assisting a company in seeking an urgent injunction to restrain a former director and employee of the company in connection with a contractual restraint and breach of fiduciary duty claim.
  • Assisting with acting for a former owner of a business in resisting an attempt by the buyers of the business to impose a restraint of trade provision under the sale and purchase agreement.
  • Assisting in obtaining competition approvals for a wagering operator for a business offering that may otherwise be subject to restrictions under the Competition and Consumer Act 2010.
  • Assisting with formulating advice to a sports governing authority around potential data privacy matters in connection with the proposed use of facial recognition technology.
  • Assisting with providing guidance to various clients in relation to their response to suspected data breaches, as well as assisting with drafting data privacy policies, data breach response plans and policies regarding the management of employee personal data.
  • Assisting with a conciliation meeting before the Fair Work Commission regarding protected industrial action taken by employees during enterprise bargaining negotiations.
  • Assisting with reviewing employment contracts for compliance with statutory entitlements, modern awards and other industrial instruments.
  • Assisting with advising a commercial tenant in relation to rent review notices issued by the landlord for several leased properties.
  • Assisting with the completion documentation for the financing facility to be issued to the developer for a residential apartment project in Perth.
  • Preparing retail and commercial property leases and hotel management agreements.
