About Chance

Chance McCraw is an associate in the Litigation Practice in our firm’s Dallas office. His practice encompasses complex commercial and healthcare litigation, including contract disputes, False Claims Act issues, government investigations, shareholder disputes, securities litigation, and insurance coverage and reimbursement disputes.

Chance has extensive experience at every stage of litigation. He has deposed and defended over a dozen fact and expert witnesses, questioned witnesses at trial, and achieved successful decisions for his clients at arbitration. Chance has successfully managed large case teams, briefed legal issues at every stage of litigation and driven cases to quick conclusions.

Chance enjoys supporting veteran and religious liberty clients with his pro bono services. He has helped veterans succeed in their appeals or claims for benefits. He has also represented members of a religious minority in a lengthy dispute with an issue of first impression certified to the Supreme Court of Texas.

Chance previously clerked for the Honorable Jane J. Boyle of the US District Court for the Northern District of Texas.

Chance graduated from the University of Virginia School of Law where he served as the managing editor of the Journal of International Law and received the Reider-Otis scholarship. He also served on the boards of multiple organizations during law school.

Experience

Healthcare

  • Represented a national provider of laboratory services in qui tam litigation where the exclusion of relator’s expert witness resulted in a confidential settlement before trial.

  • Successfully defended a national home health provider in qui tam litigation with a retaliation claim, resulting in a confidential settlement before the close of discovery.

  • Represented a third-party hospital provider in responding to a federal civil investigative demand (CID) regarding services provided by a formerly employed physician.

  • Represented a hospital in responding to a federal CID regarding hospice services.

  • Defended a physician group providing neonatal services at a hospital against a relator bringing claims under the Texas Medicaid Fraud Prevention Act.

  • Defended physicians in federal qui tam litigation where the relator alleged that the physicians overcharged Medicare for drugs and achieved a dismissal before responding to the complaint.

  • Represented a national laboratory provider in a federal qui tam investigation regarding the provision of urine drug testing services provided during the opioid crisis.

  • Prevailed at arbitration against defendant-insurers that underpaid for emergency services provided to insureds by a hospital.

  • Achieved successful settlements against defendant-insurers in multiple state and federal jurisdictions for the underpayment of in-network and out-of-network services provided to insureds by hospitals.

  • Represented a provider of in-home care services under New York’s Consumer Directed Personal Assistance Program (CDPAP) against defendant-insurers for breaches of their contracts.

Commercial

  • Represented a national aerospace manufacturer in litigation regarding the acquisition of a manufacturing plant producing key components for defense acquisition.

  • Managed discovery in a trade secrets dispute for a national aerospace manufacturer against an aerospace company startup.

  • Achieved dismissal of a class action shareholder complaint before class certification in a case involving breach of fiduciary duty and misrepresentation claims against corporation and corporate officers.

  • Energy

  • Advised an international oil company regarding strategy for defeating activist shareholder proposals.

Consumer Finance

  • Represented a defendant-credit reporting agency in over a dozen disputes involving plaintiff credit reports and achieved the lowest settlement average in the firm.
