About Kelly

Kelly Singer is a partner in the Restructuring & Insolvency Practice Group and is based in the Phoenix office. Kelly practices nationally in all transactional and litigation aspects of commercial bankruptcy, restructuring and workout matters. Kelly has substantial experience representing debtors and creditors in bankruptcies and out-of-court restructurings, buyers in bankruptcy asset sales, trustees and lenders in bankruptcy financings. His practice further encompasses both general corporate and litigation matters, including receiverships, and he has served as trustee/agent for liquidating and reorganized entities.

Through two decades of practicing law, in addition to advising on restructuring matters, Kelly has considerable experience in navigating a variety of legal and business issues. Kelly advises clients in a broad spectrum of industries, including healthcare, energy, real estate and private equity. He has also represented sovereign and cooperative organizations, as well as various Japanese, Chinese and European companies in US and foreign matters.

Experience

  • Debtor’s counsel to an oil and gas service provider in a Southern District of Texas bankruptcy; successfully sold the business as a going concern and obtained confirmation of the Chapter 11 plan.
  • Counsel to a private equity firm that successfully purchased a rural hospital in an Arizona bankruptcy.
  • Counsel to a creditor, the world’s largest private jet company, in connection with a contentious Chapter 11 case pending before the Northern District of California; argued three separate appeals before the Ninth Circuit Bankruptcy Appellate Panel.
  • Counsel to a major secured creditor and plan sponsor of a technology company in a Delaware bankruptcy; obtained confirmation of the Chapter 11 plan.
  • Committee counsel and liquidating agent to a Phoenix-based shipping and packaging company under a confirmed liquidation plan in Arizona.
  • Committee counsel in a Nevada-based rural hospital reorganization.
  • Purchaser’s counsel to a disaster-relief catering company in its acquisition of an Alaska-based business in an Arizona bankruptcy.
  • Purchaser’s counsel to a coal mine operator that successfully acquired multiple coal mines in a Southern District of Texas bankruptcy.
  • Counsel to a non-operating interest holder and creditor of an offshore oil well in connection with a Southern District of Texas bankruptcy.
  • Counsel to the receiver appointed over the assets and operations of a fiduciary for various retirement plan sponsors.
  • Corporate counsel to a Taiwanese company that acquired businesses in the US and Canada.
  • Debtor’s counsel to a Native American-chartered corporation that owned and operated a world-famous tourist attraction at the Grand Canyon.
  • Counsel to various banks and other lending institutions in the context of in- and out-of-court restructurings and litigation matters, including receiverships.
  • Counsel to the Chapter 11 trustee in one of the largest real estate-related bankruptcies in Arizona.
  • Representing the corporate owner of a professional ice hockey franchise in its widely publicized Chapter 11 bankruptcy.
