Rachel Lendich is an associate in our Construction & Engineering team who assists clients with drafting and reviewing construction works contracts, goods and services contracts and supply contracts for construction projects.
Rachel also assists with dispute resolution processes, including adjudication applications and litigation proceedings, in relation to claims arising from construction projects.
Prior to joining our Construction & Engineering team, Rachel completed a graduate rotation in our Labour & Employment Practice, where she assisted with contentious and non-contentious workplace matters, drafting employment contracts and documentation, and due diligence reporting.
Assisting with preparing and reviewing construction contracts and supply contracts (design and construct contracts, major works, minor works and procurement contracts), including for compliance with the Building and Construction (Security of Payment) Act 2021 (WA).
Assisting with drafting an adjudication application in relation to a dispute arising from a supply contract and a construction contract for an oil and gas project.
Assisting with drafting affidavits for proceedings commenced in the Supreme Court of Western Australia, including attending briefings with counsel.
Assisting with a cross-border dispute arising out of a goods supply subcontract, including seeking a stay of proceedings commenced in the High Court of New Zealand and conducting an analysis of the correct dispute forum based on the governing law of the subcontract.
Assisting with an analysis and advice on delay and disruption claims for a major construction dispute.
Assisting with advising on and drafting of contractual departures (including preparing a deed of release, show cause letter, and redundancy and/or termination of employment letters).
Assisting an employer with a potential breach of restraint of trade against a former employee.
Assisting with drafting employment contracts, including for compliance with statutory entitlements, modern awards and other industrial instruments.
Assisting with drafting employee documentation, including employee handbooks, policies and procedures, for employers.
Assisting with representing various employers in matters before the Fair Work Commission, including for allegations of unfair dismissal, general protection and disputes in respect of industrial instruments under the Fair Work Act 2009 (Cth).
Assisting with representing an employer in relation to an alleged underpayment claim before the Western Australia Industrial Magistrates Court, including drafting and filing of submissions and affidavits.
Assisting with representing an employer in relation to a racial discrimination complaint being heard before the Equal Opportunity Commission.
Assisting with employment due diligence in relation to business acquisitions for both vendors and buyers.
Completing discovery and document review in relation to workplace dispute proceedings in the Federal Court of Australia.
