State law requires employers who receive state funding to pay prevailing wages. But what exactly are "prevailing wages"? Who monitors the payment of prevailing wages – the contractor, the public authority or both? What about mixed public and private developments – where does the prevailing wage portion begin and where does it end? And what happens if the project also receives federal dollars?
These are only some of the questions currently being litigated in courts across the state. The Supreme Court of Ohio is accepting more prevailing wage cases than ever before. At a time when economic conditions have forced both public entities and developers to devise creative funding arrangements, the prevailing wage law has taken on a significance not seen since the 1930s. As failure to comply with the law can result in automatic fines and the assessment of attorneys’ fees, knowing the ins and outs of the law is critical.
