We will discuss the issue of the proper legal form for a startup in consideration of its respective situation and dynamic. We will thereby also address the tax consequences of each company structure and provide information on what needs to be considered for an optimal tax solution for a startup.

  • Which legal form fits my startup?
  • How important is the objective and development phase of the startup in this regard and when do I need to make a decision on the appropriate legal form?
  • What are the legal consequences of this decision for me as the founder as well as for the company?

6.15 pm Dr. Annette Demmel: General Terms and Conditions of Business, Terms of Use, Cloud Services and Data Protection for Startups?
  • General information of designing contracts: Is it advisable to use open source software? What contractual aspects need to be considered when creating Internet platforms? 
  • What pitfalls exist in connection with the law governing general terms and conditions of business and what needs to be considered in the case of terms of use for consumers?
  • Data protection: What essential requirements must be observed? What legal aspects must be considered when negotiating with cloud service providers? Use of data sets for big data?

7.15 pm Sebastian Dücker: Nine Months Minimum Wage Act – Experiences, Problems, Solutions

Since 1 January 2015, all employees in all sectors in Germany are entitled to be paid minimum wages. In the media, the administrative expenses especially for the comprehensive documentation duties have been a topic of discussion. We will be analyzing:

  • Which initial experiences exist and what consequences can be concluded in this respect?
  • What other duties and risks need to be observed for startups?
  • What needs to be considered when designing contracts with employees and other contractual partners?
  • Are there any exceptions for startups?
