The panel will discuss the scope and applicability of the Foreign Corrupt Practices Act (FCPA),
especially in an era of heightened enforcement and enhanced penalties, and the importance
of a comprehensive anticorruption compliance program, and will explore the ethical issues
faced by in-house counsel while advising their clients regarding FCPA and compliance
programs, including current law, ethics rules and common issues faced by in-house counsel
regarding “who is your client” and how in-house counsel can recognize and manage such
ethical issues when such issues arise.
