Increasingly, employers appear to be relying on a breach of the implied term of trust and confidence to justify the dismissal of employees. Whilst a breakdown in trust and confidence can be a potentially fair reason for dismissal, the tribunals have made it clear that employers should not use it as a convenient label to stick on any situation when they have “had enough”.
