The Fair Work Commission’s (FWC) decision in Herc v Hays Recruitment [2022] FWC 1997 highlights some of the risks for recruitment agencies when workers in multi-party contractual arrangements make claims after their engagement is terminated. In this article, we look at the recruitment agency’s successful jurisdictional objection on the basis that the worker’s rate of earnings was above the high income threshold.
