In our latest insight we look at how restructuring plans have evolved since they were first introduced. We look at the process, what happens in practice as well as reflecting on the court’s approach over time, showing how thinking and practice has developed. We also consider key areas such as when the court will cram down a plan on a dissenting creditor, dealing with the restructuring surplus and what the future might hold for restructuring plans as they continue to evolve and develop as a restructuring tool.
