Communications providers currently have a legal obligation to identify, prepare for and reduce the risk of anything that compromises the availability, performance or functionality of their network or service. However, network and service outages still occur, and the consequences of these incidents are “likely to become more severe as society becomes increasingly dependent on [electronic communications] to
function.”
This article provides a summary of the applicable legal frameworks to ensuring security and resilience of electronic communications in the EU and the UK, as well as some practical implications for network-independent communications providers.
