Antonio Bañón
Legal Director
Antonio Bañón is a legal director in the Madrid office, leading in the public law and energy areas.
Antonio has advised both private companies and public sector entities on general matters regarding public law regulations, as well as concerning different regulated sectors, such as energy, telecommunications and transport.
Throughout his career, he has participated in a large number of concessional projects and has garnered extensive experience from a transactional perspective in various sectors, particularly in relation to energy operators from renewable sources, including the acquisition of photovoltaic, wind and hydro assets.
He has been listed in Best Lawyers since 2023.
- Advising a leading business group in the leisure sector on matters of public procurement regulations; on public aid and granting agreements; on administrative sanctioning procedures involving different administrative titles, including concessions; and on the drafting of claims requesting the economic and financial rebalancing of awarded contracts with different municipal public administrations (2019 – 2022).
- Advising a leading business group in the consumer sector on public procurement, through the drafting of different administrative appeals; on different sanctioning procedures involving health regulations; and on the application of national and regional waste management regulations (2017 – 2022).
- Advising a public entity on public procurement and general public law regulations (2021).
- Advising an important business group in the energy sector on the financing of its brownfield photovoltaic project with a total power of 19MW (2021).
- Advising a leading business group in the telecommunications sector on the regulatory aspects of the acquisition of another company holder of different administrative concessions for the private use of the radioelectric spectrum and the implications considering the current regulation on foreign direct investments (2021).
- Advising an important business group in the energy sector on the financing of its brownfield photovoltaic project with a total power of 17.5MW (2021).
- Advising a leading business group in the energy sector on the acquisition of a portfolio of photovoltaic and wind power installations in the region of Castilla-La Mancha with a total power of 66MW (2021).
- Advising a public sector company dedicated to waste management services on the identification and implementation of different PPP for the potential application of European funds from the Next Generation EU programme (2021).
- Advising on public procurement regulations for a public sector company through the drafting of various public tenders ruling contracts, as well as advising as legal counsel against administrative appeals submitted by bidders within a public tender (2020).
- Advising a leading business group in the energy sector on the acquisition of a portfolio of photovoltaic and wind power installations in the regions of Andalusia and Aragón with a total power of 65MW (2020).
- Advising an important business group in the energy sector on the sale of a portfolio of photovoltaic, wind power and hydroelectric projects amounting to a total power of 185MW (2019).
- Advising a regional government on the drafting of the law on the planning and implementation of radiocommunication infrastructures (2018).
- Representing in a court proceeding initiated by an important business group in the pharmaceutical sector concerning payment claims issued before the relevant regional public health authorities (2017 – 2020).
- Advising on best public procurement practices regarding the structuring and awarding of PPP in LATAM (2017 – 2019).
- Advising a Spanish regional government on the drafting of a technical legal memo on the different financing alternatives for the costs resulting from the O&M of the regional highway network (2017).
- Advising on an administrative proceeding for the reimbursement of a public aid granted to a company for the development of its olive oil production business (2016).
- Representing in a court proceeding regarding an administrative infraction involving the export of Cultural Interest Goods and the relevant administrative authorisation (2015 – 2017).
- Representing in a court proceeding before the Spanish National High Court regarding a sanctioning procedure initiated by the National Competition regulator (CNMC) against an important telecommunications group (2015 – 2016).
