Martin H. Falke is partner in the Labor & Employment practice based in our Berlin office. He advises and represents private and public sector employers, as well as executives in all aspects of German labor and employment law matters.

Martin has significant experience in public and private mergers and acquisitions, post-merger and acquisition integration, workforce reductions, compliance, data protection, works council issues and collective bargaining. Furthermore, Martin has extensive trial experience in wrongful termination, discrimination and breach of contract disputes, as well as disputes with works councils.

He is a certified labor and employment lawyer (FachanwaltfürArbeitsrecht).

  • Providing counsel to a German energy provider in restructuring its business, including negotiating a balances of interests and social plan with its works council.
  • Providing counsel in the shutdown of a site of an international logistics company.
  • Providing counsel in the relocation of a site of a German consulting firm, including negotiating a balances of interests and social plan with its works council.
  • Providing counsel in the acquisition of a several German care homes by a private equity fund.
  • Advising a US engineering company in the restructuring of its German operations.
  • Representing numerous German employers in dismissal protection lawsuits.
  • Representing numerous German employers in lawsuits with works councils.
  • Drafting and negotiating a house-tariff agreement with the public sector union and several collective bargaining agreements with the physicians union for German hospital operators.
  • Providing counsel in the sale of a public hospital to a private hospital operator.
  • Advising US clients on the implementation of HR policies in German subsidiaries.
  • Negotiating several shop agreements with works councils, including dispute resolution before the arbitration committee.
