Brent Henderson
Partner
Brent Henderson is a partner in the Real Estate team, who has more than two decades’ experience advising on high-profile and complex construction and infrastructure projects, including those in roads, rail and water.
Brent advises primarily on the front end of construction and infrastructure projects, with particular expertise in assisting clients on project delivery support and claims management.
His clients include government and statutory bodies, private sector tenderers, consortia and contractors involved in major road, rail, infrastructure and telecommunications projects, including PPPs.
- Advising a key subcontractor on the Sydney Light Rail and Parramatta Light Rail projects.
- Advising the Victorian government on the Victorian Desalination Plant PPP.
- Advising Macquarie, as project sponsors, on initial feasibility, and negotiation of the project deed, concession and design and construction contract documentation on the Gold Coast University Hospital and Carpark PPPs.
- Advising the Commonwealth Department of Defence in relation to the project brief, design brief, tender and contract documentation, procurement process and project administration for the following key infrastructure procurement and upgrade projects:
- Puckapunyal base (HV infrastructure upgrade)
- HMS Edinburgh (DTSO enhancement)
- HMS Albatross (base upgrade)
- Project Redfin (national antenna upgrade)
- Townsville base upgrade
- Advising Barwon Water on its water infrastructure projects.
- Advising SA Water on the South Australian Desalination Plant and Transfer Pipeline Projects.
- Advising Lendlease Engineering on the Western Distributor Project, Melbourne Tulla Widening Project, Pacific Highway Upgrade W2B, WestConnex Gateway project and TNR3 Northern Road Upgrade project.
- Advising the City of Parramatta Council on its transport and infrastructure projects, including, most recently, its West Epping Park, Parramatta Square and the Parramatta Wharf upgrade projects, including related project disputes.
- Advising Downer EDI Rail/Downer Group on the Waratah Train PPP Project, including:
- Advising on project documentation and key construction and operations/maintenance arrangements, and providing ongoing advice and support on subcontractor claims management and dispute resolution
- Advising on supply package contracts (including communications, gangways, doors, brakes and couplers), including advising on contract administration requirements, settlement of disputes with suppliers, preparation and implementation of internal warranty and defects management procedures and shipping arrangements to and from Changchun/Dalian
- Advising BSA Limited on its contracting arrangements for the New Royal Adelaide Hospital PPP, management of contract claims, SOPA adjudications and settlement negotiations with the head contractor JV, including achieving successful significant SOPA determinations.
