Maura McIntyre is a senior associate in the Restructuring & Insolvency Practice Group.

Maura’s practice focuses on financial restructuring, corporate trust matters and workout proceedings on behalf of financially distressed companies or their creditors, including representation of debtors, indenture trustees, creditors and creditors’ committees, investors and purchasers in complex chapter 11 cases and out-of-court restructurings. Maura has significant bankruptcy litigation experience from her work on complex chapter 11 cases, representation of mortgage servicers in chapter 13 proceedings, and representation of creditors in defense of preference actions and fraudulent transfer actions. Maura’s insolvency and restructuring practice is bolstered by her trust indenture experience, which has included representation of indenture trustees in chapter 11 cases, negotiation of direction letters, negotiations with ad hoc bondholder groups, and advising indenture trustees with respect to obligations in matters concerning defaulted securities.

Prior to joining the firm, Maura worked for an international law firm and focused her practice on representing indenture trustees in matters involving defaulted securities and chapter 11 debtors.

Maura is a member of the American Bankruptcy Institute and the Cleveland Metropolitan Bar Association.

  • Representing a West Virginia-based coal producer and its affiliated entities in their chapter 11 proceedings. The debtor at different times operated 32 properties, including surface and underground coal mines, preparation or wash plants, and loadouts or tipples, and held more than 500 mining permits. Representation included the completion of an auction and sale process for substantially all of the debtors’ assets over the course of 11 days, resulting in the preservation of hundreds of jobs, realization of approximately US$42.9 million in cash, and assumption of approximately US$471.1 million in reclamation liabilities alone.
  • Representing a Kentucky-based coal producer in its chapter 11 proceedings to sell substantially all of its assets.
  • Advised Syncora as the insurer of Payment in Lieu of Tax bonds issued in conjunction with the financing of the Carousel Center (n/k/a Destiny USA) regarding concerns related to borrower distress. This involves one of the largest shopping complexes in the US.
  • Representing a group of school district creditors in the Home Team Marketing case pending in the District of Delaware.
