Sharon Milton is an experienced lawyer who has represented clients in proceedings before all Western Australian state courts (the Supreme Court, District Court and Magistrates Court), the Federal Court of Australia and a range of other administrative tribunals.

Sharon’s experience includes advising on disputes across competition and consumer law actions, areas of civil law including breaches of contract, Corporations Act litigation, tenancy and real estate disputes, and insolvency matters.

In addition to Sharon’s work at other commercial law firms, she has worked as in-house legal counsel for a state government department and in the not-for-profit community legal sector, making her well versed in acting for both private and public sector clients.

  • Managing proceedings in the Supreme Court of Western Australia against an automotive auctioneer for fraudulent, misleading and deceptive conduct claims, including attending mediation and extensive negotiations, in a long-running matter where resolution was complicated by the defendant.
  • Assisting in negotiating the settlement of an AU$30 million professional negligence claim.
  • Acting in multiple debt recovery matters in both the District Court and Magistrates Court of Western Australia, including providing advice, preparing letters of demand and representing as required, but with a focus on negotiating resolution of matters to avoid hearings or trial.
  • Advising on a sports law matter, where a notice of breaches had been issued with the potential for further criminal sanctions. Through a negotiated resolution, the client received a temporary sanction in the sport, but avoided further penalty and jeopardising their professional career.
  • Representing a medical professional during an investigation by the Australian Health Practitioner Regulation Agency (AHPRA), including representing during the interview process and preparing responsive submissions to avoid further investigations.
  • Representing a former company director and secured creditor in Supreme Court of Western Australia proceedings against a court-appointed receiver alleging maladministration of the appointment. The matter involved issues of fiduciary and statutory duties under the Corporations Act 2001 (Cth), as well as related equitable claims, and was successfully resolved through negotiation without proceeding to trial.
  • Representing a former company director in Supreme Court of Western Australia proceedings involving allegations of breaches of statutory and fiduciary duties, and/or contractual breaches while simultaneously commencing winding-up proceedings on grounds of oppressive conduct.
  • Advising a corporate client on a potential claim for purported breach, repudiation and termination of contract, as well as a potential counterclaim for misleading or deceptive conduct.
  • Assisted in representing a former company director in Federal Court of Australia proceedings for breaches of statutory and fiduciary duties.
  • Advising a private individual on breach of contract and professional negligence claims for negligent legal advice received in a family law matter.
  • Representing government clients in debt recovery proceedings before the Magistrates Court of Western Australia.
  • Representing clients facing criminal prosecutions commenced by the Australian Tax Office in sentencing hearings before the Magistrates Court of Western Australia.
