Rachel Pachacz is a senior associate in our Energy & Natural Resources Practice Group. She provides contentious and non-contentious advice on construction, energy and natural resources projects. Rachel also has experience in international arbitration.

Rachel was the 2022 winner of the Law Council of Australia’s Tom Yuncken Australian Young Construction Lawyer Award.

Contentious

  • Acting for a contractor in a multibillion dollar international arbitration regarding claims arising out of an engineering, procurement and construction contract for an LNG project.
  • Acting for a contractor in a multibillion dollar international arbitration regarding claims arising out of a subcontract for the construction of a power plant on an LNG project.
  • Acting for a creditor in a claim against the administrators of a mining and export company in the Supreme Court of Western Australia, and, on appeal, before the Western Australian Court of Appeal, regarding whether, among other things, the use of a “holding” deed of company arrangement was permitted under part 5.3A of the Corporations Act 2001 (Cth).
  • Acting for a car and truck hire company in a claim against a mining services company (formerly under administration) and the former administrators in the Supreme Court of Western Australia, regarding breach of contract and liability under sections 443B(2) and 443D of the Corporations Act 2001 (Cth).
  • Acting for a telecommunications subcontractor in a claim against a telecommunications contractor in the County Court of Victoria regarding breach of contract.
  • Acting for the plaintiff in an application to wind up an oil and gas company on the ground of insolvency in the Supreme Court of Western Australia.
  • Acting for a shareholder in an application to wind up a company under section 233 of the Corporations Act 2001 (Cth) in the Supreme Court of Western Australia.
  • Acting for the plaintiff in an application to set aside a statutory demand in the Supreme Court of Western Australia.
