Thulasy Packianathan is an associate in the Litigation Practice Group. Thulasy has represented clients in the English High Court and in commercial arbitration.

Thulasy’s court experience includes representing a client in a two-week trial in respect of a breach of an oral contract claim, and applications to the Commercial Court for enforcement of arbitral awards, asset disclosure orders and worldwide freezing orders. She is also experienced in obtaining orders for contempt of court, including penal sanctions, against defendants breaching High Court injunctions.

    Commercial Litigation

    • Representing an investment bank at trial in a US$18 million claim in relation to a breach of an oral contract concerning a multibillion-dollar merger between two global mining companies.
    • Claiming against a trustee for breach of its fiduciary duties in relation to shares it held for the claimant. Having proceeded with a summary judgment application for the transfer of shares and subsequently receiving a ruling on taxation from the Swiss authorities, the trustee agreed to transfer the shares.

    Enforcement

    • Acting for a US grain multinational to enforce a GAFTA award against a Moroccan company through an asset disclosure order and a worldwide freezing injunction (ADM v. GHI), obtaining a 12-month prison sentence against the director of the defendant.
    • Acting for a US grain multinational to enforce a GAFTA arbitration award. Successfully obtained an asset disclosure order and a worldwide freezing order following the court’s permission to enter judgment against an Iranian company in the terms of the GAFTA award.

    Commodities And Shipping Arbitration

    • Obtaining an award for a US grain corporation of over US$6 million in a NAEGA arbitration against an Egyptian oil extraction company after the tribunal found that our client had the right to terminate the contract and hold the defendant in default.
