Experience

  • Assisting in proceedings before the Supreme Court of Victoria in defending counterclaims against lenders regarding unconscionable conduct, fraud, undue influence and misrepresentation.

  • Assisting in proceedings before the Supreme Court of Western Australia defending claims against receivers and managers, for loss and damage caused. Work included preparing for mediation and making a security for a costs application.

  • Assisting in advising an Australian Securities Exchange (ASX)-listed medical-aesthetic company in relation to contractual rights against a manufacturer, as well as available causes of action for breach of contract in the New South Wales jurisdiction.

  • Assisting in advising receivers and managers in relation to national franchise insolvency, including negotiating costs allocations with appointed voluntary administrators and reviewing Personal Property Securities Register (PPSR) registrations.

  • Assisting in advising various secured creditors in relation to corporate insolvencies, including drafting advice regarding reports provided to the secured creditors and consequences of abstaining from voting, and assisting with advice regarding effects of proof of debt.

  • Assisting in advising a New York Stock Exchange (NYSE)-listed oilfield services company in relation to the reconstruction and amalgamation of its corporate group in Australia, as well as the treatment of preference shares in the context of the restructure, including drafting the application to the Foreign Investment Review Board (FIRB).
