Kevin Kumar is a seasoned litigator in our Los Angeles office with extensive experience handling high stakes matters through trial and arbitration. He represents automotive manufacturers, technology companies and other corporate clients in high-stakes product liability, automotive and transportation, catastrophic injury and complex commercial litigation.
Kevin handles matters at every stage, from pre-litigation assessment and early case strategy through fact and expert discovery, motion practice, mediation, arbitration, trial and appellate review. He develops litigation and discovery strategies, takes and defends depositions, works closely with technical and medical experts, briefs and argues significant motions and advises clients on litigation risk, settlement strategy and resolution.
His practice frequently involves complex technical and causation issues, including vehicle inspections, accident reconstruction, vehicle and operational data, emerging transportation technologies, biomechanical analysis and medical causation. Kevin also counsels clients before litigation is filed on product claims, commercial disputes, evidence preservation, technical investigations, potential exposure and opportunities for early resolution.
Kevin devotes substantial time to pro bono and community service. He serves on the Board of Directors of the Foundation for Early Childhood Education. Earlier in his career, he served as a law clerk with the California Attorney General’s Office and as a judicial intern to the Hon. Gregory W. Pollack of the Superior Court of California.
Defended a rideshare technology company in a three-week arbitration involving a high eight-figure demand, significant orthopaedic and neurological injury claims, complex medical causation and biomechanical issues, as well as disputed theories of direct and vicarious liability. Following testimony from numerous fact and expert witnesses across several disciplines, the arbitrator awarded a seven-figure sum; less than 9% of the amount sought by the claimant.
Represented a global automotive manufacturer in federal contractual-indemnity litigation arising from a high-exposure putative class action; obtained partial summary judgment and, following trial, secured a substantial recovery for the client.
Served as co-lead counsel for a national vehicle-rental company in a multiday arbitration involving claims of unintended acceleration and brake failure in a rental truck, with alleged orthopaedic injuries requiring cervical surgery. The defense centered on vehicle inspection and testing, alleged pedal misapplication, biomechanical and medical causation, as well as challenges to the claimant’s liability and damages theories.
Represented a rideshare technology company in double-fatality wrongful-death and catastrophic-injury litigation arising from a high-speed motorcycle collision, involving accident reconstruction, video evidence, digital and vehicle data, and complex liability and causation issues.
Represented a global automotive manufacturer in catastrophic-injury product-liability and crashworthiness litigation arising from a fixed-object collision, involving allegations of airbag nondeployment, seatback failure and roof crush, with complex issues concerning event-data analysis, restraint-system performance, vehicle structure and enhanced-injury causation.
Secured dismissal of a global heavy-equipment manufacturer from a California personal-injury and product-liability action arising from the operation of construction equipment.
Defended an autonomous vehicle company in personal injury litigation arising from a collision involving a cyclist, including dispositive motion practice addressing statutory duties, causation and third-party conduct.
Served as pro bono appellate counsel in a complex federal criminal appeal before the US Court of Appeals for the Tenth Circuit involving drug-trafficking, kidnapping and firearm convictions, briefing significant evidentiary and sentencing issues and presenting oral argument before the court. The appeal resulted in a published opinion.
