About Lianne

Lianne Mantione’s practice includes all aspects of environmental law with particular emphasis on risk management counseling, regulatory advocacy, enforcement defense, and litigation of complex environmental matters involving Clean Air Act or chemicals regulatory issues.

Lianne regularly counsels clients on developing compliance and risk management strategies, with a focus on understanding the client’s operations and business strategy to ensure effective and efficient counsel. She has also defended clients in federal and state agency enforcement actions, federal rulemaking appeals, and federal and state toxic tort and mass tort actions (including class action cases), and represented clients in multiple federal and state administrative appeals.

In addition to her juris doctor degree, Lianne holds a master’s degree in environmental studies. Lianne is the editor-in-chief of our frESH blog, which provides observations on significant environmental, safety and health developments from around the world. It offers a forum for discussion on expected policy shifts, influential opinions and decisions and compliance obligations.

Experience

Regulatory

  • Counseling major corporations in multiple states on federal and state regulatory compliance, enforcement defense, and risk mitigation strategies related to Clean Air Act issues including Title V permitting and New Source Review.
  • Counseling global chemicals industry clients on legal compliance, enforcement defense, and risk management strategies under the Toxic Substances Control Act.
  • Counseling global chemicals industry clients on crisis responses, including addressing health and safety concerns and potential contract and regulatory violations, and managing response teams in the US, Europe and Asia.
  • Representing clients in multiple administrative appeals in Ohio, Pennsylvania and Indiana challenging Clean Air Act permitting terms and conditions.
  • Counseling an international engine manufacturer and US engine component manufacturer on US engine regulations for mobile and stationary sources, including certification, permitting, exemptions and reporting.
  • Defending clients in negotiations with federal, state and local authorities to resolve alleged air and water permit violations.

Litigation

  • Challenging US EPA residual risk and technology review rulemakings for National Emission Standards for Hazardous Air Pollutants for the iron and steel industry on behalf of national trade association and impacted client member.
  • Challenging a US EPA denial of SO2 State Implementation Plan revision impacting a client’s facility, including leading negotiations with the federal and state agencies on a rulemaking resolution.
  • Defending a metals industry client in a multimillion-dollar US EPA and multi-state agency air enforcement action involving several client facilities.
  • Defending a metals industry client in multiple federal and state toxic tort cases including a federal class action asserting claims for medical monitoring, personal injury and property value diminution based on alleged air pollution (including particulate matter and manganese).
  • Defending a national paper industry client in a toxic tort class action and obtaining a key victory on an issue of first impression under the Class Action Fairness Act of 2005 (CAFA) in an appeal before the Eleventh Circuit Court of Appeals.
  • Defending client in CERCLA cost-recovery and contribution cases relating to former iron foundry and coke plant operations.
  • Representing clients in multiple administrative appeals in Ohio, Pennsylvania and Indiana challenging Clean Air Act permitting terms and conditions.
