Lorena Fatás is a partner in the Litigation Practice Group, specialising in international arbitration, energy, and environmental law. She brings extensive experience in complex litigation, public law and economic regulation, with a particular focus on disputes involving states and regulated sectors.
Before joining the firm, Lorena built a distinguished career at the Spanish State Attorney’s Office, where she represented the Kingdom of Spain in high profile international and domestic proceedings. She has significant experience in investor state arbitration, having acted in numerous cases under the Energy Charter Treaty before leading institutions such as ICSID, UNCITRAL and the Stockholm Chamber of Commerce.
In addition to her international arbitration work, Lorena has advised and represented key public institutions in regulatory and administrative disputes, particularly in the energy and financial sectors. She also has substantial experience in criminal proceedings as a private prosecutor, notably in cases involving tax evasion, fraud and misappropriation of public funds.
Lorena holds degrees in law and business administration from the University of Zaragoza, as well as a diploma in European Union law. She began her career in private practice before joining the Spanish State Attorney’s Office through a highly competitive national examination. She is admitted to the Madrid Bar Association and speaks Spanish, English, German and French.
Litigation and Arbitration
Represented the Kingdom of Spain in numerous landmark ICSID and SCC arbitration proceedings arising under the Energy Charter Treaty.
Acted as counsel for the Kingdom of Spain in over 20 arbitration and annulment proceedings, including numerous large-scale disputes with contested amounts exceeding €100 million.
Coordinated global defence strategies and local counsel in cross-border disputes involving annulment, set-aside, recognition and enforcement proceedings across multiple jurisdictions – including the US, the UK, Australia, Israel, Switzerland, Brazil, Germany, the Netherlands, Luxembourg, Belgium and Sweden – with total amounts in dispute exceeding €1 billion.
Represented the Ministry for the Ecological Transition and the Demographic Challenge in complex energy disputes, including challenges to the legality and constitutional compliance of legislation and the denial of permits for large-scale renewable energy installations (over 50MW).
Represented the Spanish National Commission on Markets and Competition (CNMC) in disputes concerning access to the electricity grid, including connection rights, capacity allocation and regulatory compliance.
Represented the CNMC in a wide range of regulatory litigation, including antitrust, telecommunications, transport and audiovisual matters.
Represented the Ministry of Economy, Trade and Business in banking-related claims involving boards of directors and senior management misconduct, breaches of remuneration policies, anti-money laundering (AML) compliance and accounting irregularities.
Represented the Ministry for the Ecological Transition in environmental and coastal protection disputes.
Prosecution
Acted as private prosecutor on behalf of the Spanish Tax Agency in cases involving tax evasion, fraudulent insolvency and financial crime.
Represented the Spanish government in criminal proceedings involving embezzlement of public funds and fraud-related offences.
Acted as defence counsel representing public officials in proceedings related to acts undertaken in the exercise of their official duties.
Government Advisory
Advised the Kingdom of Spain on UNCITRAL Working Group III, and on the negotiation and modernisation of international investment treaties.
Advised state-owned entities and public authorities, including the national water infrastructure company and river basin authorities.
Counselling Castellón Port Authority, a state-owned body responsible for managing and operating the Port of Castellón.
Advised expropriation authority on the legality of expropriation proceedings and the determination of fair compensation.
