On Tuesday, October 11, 2022, Julia Jacobson, David Naylor, Gicel Tomimbang and Elizabeth Berthiaume presented to the Association of National Advertisers (ANA) on an automated processing case study, focusing on legal guardrails to protect businesses from unwanted legal consequences.

Automated processing is the term often used to describe technology that businesses use to organize and make decisions about data, and encompasses technology colloquially referred to as artificial intelligence and machine learning.

When automated processing involves personal data – such as through consumer profiling or in-store consumer experiences – privacy laws impose different obligations depending on the types of personal data processed, how the results of the automated processing are used (i.e., how significant the effect on an individual) and whether or not the decisions made involve human input. Julia, David, Gicel and Elizabeth provided detail on the impact this has on businesses.
