The team provides a full-service offering, advising on all aspects of the UK’s points-based immigration system, particularly under the skilled worker and global business mobility routes. We also advise in relation to all other employee-related immigration matters, including indefinite leave to remain and naturalisation applications, UK entry requirements for family members, applications under the EU Settlement Scheme and ancestry visas.
We have particular expertise in relation to sponsorship compliance matters, devising and implementing extensive compliance programmes and internal audits, as well as preparing clients for and attending Home Office compliance visits. We also have an excellent record of successfully defending illegal working civil penalties and challenging sponsor licence suspensions and revocations.
We have unparalleled expertise in advising on the immigration aspects of corporate transactions, restructures and TUPE, which if not addressed promptly and correctly can jeopardise a business’s ability to retain its international workforce and sponsor new work visas.
As part of our Labour & Employment Practice Group, we advise on the often-problematic overlap between immigration and employment law, particularly in relation to illegal working (and related dismissals) and the risk of discrimination claims for refusing to sponsor eligible candidates or employees without an objective justification.
We advise clients on overseas remote working – an increasingly complex area in which the team excels given its project management experience across multiple jurisdictions and disciplines including immigration, tax and social security, employment, data privacy, pensions and health and safety.
Following Brexit, we have supported numerous global organisations to address the impact of the end of EU free movement, including advice on structuring international assignments, lesser-known immigration routes for service providers and in-depth analysis and risk assessments across multiple jurisdictions relating to the use of visitor visas to undertake business activities.
